Amidst all the twists and turns in the quest to get justice for Sushant Singh Rajput, it is slowly becoming apparent that the main issue has been sidelined and the tussle has slipped into a show down between the Centre and the State. A day after Rhea’s arrest by the Narcotics Central Bureau (NCB), it has been revealed that a special court here will hear the bail applications of the actress and her brother Showik on September 10. Rhea, who was Sushant Singh Rajput’s girlfriend, was arrested on Tuesday by the NCB after being charged under the Narcotic Drugs and Psychotropic Substances Act for her alleged role in the drugs angle that has emerged during investigation into the June 14 death of Sushant. In the 20-page bail application, Actress Rhea Chakraborty has claimed that she was coerced into making self-incriminatory confessions during custody and that she has been falsely implicated in the present case. In the meantime the war of words between Actress Kangna Ranaut on the one side and the Shiv Sena seems to have entered a new dimension. While Kangana Ranaut got Y+ security from the centre over indirect threats being given to her, the BMC swiftly move in and after serving a day’s notice in an old case, moved in to dismantle the illegal structure that Kangana had allegedly built in her premises.
This swiftly brought in the Bombay High Court on the same day ie. Wednesday who stayed the demolition process initiated by the BMC for illegal construction at actor Kangana Ranaut’s bungalow. The speed at which the actions have preceeded in the last couple of days in Mumbai belie the oft repeated claims of lethargy and Inaction of Indian govt bodies, be it the Municipal Corporations or the Judiciary. Justice S J Kathawalla while hearing a petition filed by Ranaut sought to know from BMC as to how it entered the premises and directed it to file an affidavit in response to the plea. The Brihanmumbai Municipal Corporation (BMC) on Wednesday undertook demolition of the illegal alterations at the Bandra bungalow of Ranaut. Meanwhile the Kashmiri Pandits seem to have risen up in support of Kangana Ranaut along with other organizations like the ‘Karni Sena’ In a statement issued by Satish Mahaldar, Chairman, Reconciliation, Relief and Rehabilitation of Migrant Kashmiri Pandits Organization condemned the BMC action against Bollywood actress Ms Kangana Ranaut. “We extend our support to her in this hour of concern when her house in Mumbai has been bulldozed in her absence”, he said.
“It is disheartening that the administration in the Maharashtra government acted in such haste. This action, no doubt stems from political vendetta and highhandedness given the fact that every year so many houses/buildings collapse and people die in Mumbai alone and the government is caught sleeping. Bulldozing her house when she was away and without adequate notice period is unbecoming of a government. The action is a demonstration of political might and harassment” Mahaldar said. he further added, “Since the Maharashtra government has ill-treated her, we the Kashmiri Pandits request her to live with our community as our daughter.’ In the recorded statement released on twitter, Ms Kangana Ranaut had said that she can empathize with the Kashmiri Pandit refugees who also lost their homes and hearth in Kashmir 30 years ago. She has said she can understand the pain of being uprooted. The Organization appreciated that Ms Ranaut was one of the Bollywood actors who had spoken about the plight of Kashmiri Pandits for the first time in 30 years. Mr Mahaldar on behalf of the organization thanked Kangana for feeling and speaking about the plight of Kashmiri Pandits, who have been suffering for the past three decades. Kolkata: It is true that passion knows no bounds. “Dance is my pran, atman and soul. I loved both part of my life – being a dancer and a bureaucrat. I entered the world of dancing when I was barely three-year-old and before my formal education. There is a framed lehenga of mine at home which shows how small I was when I was initiated into dancing,” said kathak guru Padma Shri, Shovana Narayan, while connecting with a cross-section of audience across India through a session of Ek Mulakat presented by Shree Cement and organized by Prabha Khaitan Foundation. Shovana was responding to a question from kathak exponent and conversationalist Shinjini Kulkarni of Ehsaas Women – “How did you manage to become a dancer and a bureaucrat?” Shovana, a woman of stupendous achievements, is a kathak guru, choreographer, former bureaucrat, author and a researcher. Belonging to the guru-shishya parampara (tradition), Shovana believes in expanding the boundaries of kathak through cross-cultural experimentation and innovation in dance styles while rooted to kathak’s ancient Indian tradition. Sharing her findings on how ancient kathak was, Shovana said, “An epigraph from Kameshwar archive in Mithila has been confirmed by epigraphists to date back to the Mauryan period which is BC. The inscription in prakrit and brahmi lipi clearly mentions kathak as devotional dancing and mentions the region around Varanasi.” “The kathak dance we see today is very different from the kathak community. The sculptures depicting dance forms in today’s standing temples, at best, go back to about a 1000 to 1100 years. So where are the temples and sculptures of the Gupta and Mauryan period which were so rich in architecture and sculptures! We don’t look into the small museums and archives of India which is the haven of information. That is where we have to see and find continuity in the form and stance of the kathak dance,” Shovana said. “I believed in myself and have never deviated from kathak, I was true to my kathak tradition just like the Western classical dancers were to their’s. So what did we do? We just found commonality in terms of poems, moods and even movements but the emphasis, the field and flow, as in the approach, tenor and flavour is different. I am careful about using the term fusion which means I lose my identity to merge myself into something. With a change in society, marital relations have undergone a sea change. But they are still being governed by archaic laws which have lost touch with reality. “The law of the country should always be progressive and should reflect the changing realities. Interestingly initially there were no provisions for divorce in the Hindu marriage act but they were eventually incorporated, so better faster divorce laws are the need of the hour” Says Dr. KislayPanday, the solicitor at the Supreme Court of India. Indian society has moved on since the first decade of independence. Social mores and indeed the society of 2020 are different from what it was in the 1950s. Since independence, many women have made a mark and are now moving along with men. No longer women are willing to accept male dominance and bear in silence. They are now coming out in large numbers to protest the atrocities committed by their in-laws in the name of conforming to traditions and complying with the traditional Hindu values. And this has indeed led many women and even men to move to court for divorce and to undo the nuptial knot. Failed marriages are on a rise and so are the divorce applications in the Indian courts. As both men and women are becoming more aware of their rights, they are strongly rejecting the regressive practices and silent oppression such as misogyny, patriarchy, and role-biding. And sometimes people move to court for divorce as they just can’t bear their partner for a plethora of reasons like habits, everyday quarrels, and so on. Nevertheless, getting a divorce in India is not an easy task. One has to comply with plenty of legal obligations. The judicial system works on evidence and particular frameworks. In case of the dissolution of marriage, one must prove his/ her point in the court accompanied by a valid reason. Since marriage is observed as a sacrament in India, there are only a few legal grounds for divorce. “The most interesting aspect of Indian divorce law is the reason. There are just seven reasons enumerated in the law for getting a divorce, whereas in reality there can be hundreds of reasons for not living with a spouse. If two adults do not want to live together or even one of them does not want to live with the other, they should be allowed to do so easily and without hassles” says Dr. KislayPanday, the solicitor at the supreme court of India. There has been a rapid rise in divorces in India, but in order to obtain a divorce legally, it can take anywhere from six months to 20 years. According to an estimate roughly 11 Indian marriages inevery 1,000 end in divorce though the number in the USA is 400. “The reason for this small percentage is not that people do not seek divorce but because it is cumbersome to get a divorce in India and so many couples just live as estranged couples, separated but technically still married to each other leading to many social and moral complications”, says Dr. KislayPanday. The UPA government introduced the Marriage Laws(Amendment) Bill, proposing amendments to the Hindu Marriage Act, 1955, and the Special Marriage Act, 1954, to make an “irretrievable breakdown of marriage”ground for divorce. The Bill was passed by the Rajya Sabha in 2013, but could not be taken up for discussion in the Lok Sabha. The NDA government’s concerns about “illegitimate and live-in relationships,” stalled the process. “It is wrong to believe that easier laws for divorce would lead to the breakdown ofthe marriage institution, in fact, it would end the marital misery and only those couples who want to live together would do so not to please the society or the peers”, says Dr. KislayPanday. Till the Modi government introduces the revised bill not much can be expected on this front. The law minister had once indicated that a revised bill was on anvil and would be coming up for public debate. Let’s hope that happens sooner than later. We have a National War Memorial in New Delhi in memory of our bravehearts, who laid down their lives in the line of duty. This memorial is spread over 40 acres of land and is one of the many memorials in different parts of the country. On different occasions regularly, homage is paid to our fallen soldiers and hence one may ask as to why I say that Rudyard Kipling was right. When Our Sportspersons PerformMany of us may have heard of Sakshi Malik. She hails from Haryana and became the first woman to win a bronze medal in the Olympics. She won the bronze medal in Wrestling in the 2016 Summer Olympics. In honour of this achievement of hers, she was conferred with many cash prizes from States such as Uttar Pradesh, Madhya Pradesh and also Delhi. Likewise when P V Sindhu won her silver medal in the Rio Olympics in 2016. She became the first Indian woman to do so. She too was conferred with many prizes from states such as Madhya Pradesh, Haryana and Delhi apart from her home states Telangana and Andhra Pradesh. Going back a little, Abhinav Bindra won the Gold Medal in the 10 meter air rife event in 2008 summer Olympics. This was India’s first Olympic Gold Medal since 1980. Abhinav Bindra hails from Uttarakhand and 7-8 states conferred cash prizes on him. This included the state of Maharashtra also, which conferred a cash prize of Rs. 10 lakhs. When Our Soldiers PerishNow back to Rudyard Kipling and the soldiers. In May 2020, we lost 5 of our Armed Forces Personnel in an encounter in Handwara. These 5 men were killed in action during an encounter with the terrorists. One of them was Major Anuj Sood. He was just 31years old at the time of this incident. Despite clearing the exam for prestigious IIT, he chose to join NDA. He was commissioned in 2012 and had been a resident of Pune since 2006. According to a tweet by Brig Sood, father of Maj. Anuj Sood, the State Government refused to pay the NoKs the ex gratia compensation. The reason cited was that the policy deems it necessary for a person to prove that the was a domicile resident in the state of Maharashtra for which he needs to prove that he has lived for 15 years in the State. It is believed that his family has been living in Maharashtra since 2006. What an irony! When an officer takes an oath, while being commissioned he does so as a citizen of India, not as per his State or domicile or his residence. Hence, when the likes of Maj Anuj Sood make the supreme sacrifice in Handwara (J & K) far away from his home in Pune, he doesn’t say that he is a resident of Maharashtra and he won’t fight against terrorists in Kashmir. Yet when the State Government has to make an ex gratia compensation, they want him to be a domicile citizen of their State. Isn’t the State of Maharashtra part of the nation? I am sure those who make these provisions know that Armed Forces personnel keep getting transferred every 3 years. How common is it find a 2nd generation soldier to have lived in a particular place for 15 years when his father has a transferable job? Likewise, the parents of Capt R Veera Raja Reddy. Capt Reddy made the supreme sacrifice in the line of duty while fighting terrorists in Rajouri in 2002. He was just 25 years old and had been married for 2 ½ months. His parents received an ex gratia of Rs. 5000 from the state government of Andhra Pradesh in Jan 2003 and a year later, they got a bronze statue erected in honour of their son, at their own expense, which was unveiled by Sri Vidyasagar Rao along with then Home Minister and army officials. Not only this, they received the J & K government ex gratia in 2012, 10 years later.
These are just few instances of the indifferent attitude towards the NoKs of the officers. It is a rarity that a family is given an ex gratia of Rs. 1 crore + land + job. Such instances give an impression that after a soldier’s supreme sacrifice, things are not so difficult. This may be actually be far from true. In Mumbai the parents of Lt. Nawang Kapadia have been trying to get a memorial constructed in Mahim Nature Park, Mumbai in honour of the brave hearts of Mumbai who were killed in Action. Lt. Nawang Kapadia made the supreme sacrifice while fighting terrorists in the jungles of Rajwar, Kupwara on November 11, 2000. Their family have laid a Memorial stone for him at the Mahim Nature Park. The instances related to Jawans may not even be available on public domain as such families are often not much educated or tech savvy enough to voice the hassles faced by them on social media. What if the Jawan who has been KIA is the sole source of income in a family, survived by wife, children and parents? The family members may not be so well educated or have such information about Ex gratia. Although the members of the fallen soldier’s unit are known to help with all formalities related to the compensation, it is upto the family members to be able to furnish multiple documents, affidavits and so on. An absence of any relevant document only means further paperwork and more delay in the compensation. There are instances where despite the concerned Bank possessing the order of release of pension, they take a long time (2-3 months in some cases) to do so. Common Practice Across States For CompensationI have nothing against these sportspersons who have brought glory to the Country and I appreciate their efforts and sacrifices but at the same time it is heartbreaking to note that when sportspersons bring glory to our country, the states are more than happy announcing cash prizes for these winners. Aren’t our soldiers making the supreme sacrifice while defending the same country? Why then are they not being treated in the same way? I would like to reiterate here that this is not about the Armed Forces fraternity but rather about the indifference ofa State Government, bureaucracy and the policies thereof. When the soldiers do not discriminate, then why there is such a discrimination about them? Is it not fair to have a common practice across the country? Isn’t being a citizen of India enough? How does the period of residence in a particular state make the supreme sacrifice any less relevant? How easy it is to just have a rule that a person who is a Native in a particular state will be given ex gratia compensation from that state. There are ample documents that can prove a person being a native of a State viz a viz an Aadhar Card, a PAN card and so on. So why then the need of multiple documents, affidavits and why a time frame of almost 6 months or 10 years? There are hundreds who come to pay homage to the brave heart on his final journey, an outpouring of grief on social media yet the struggle for their compensation is only of the family or at best, with support from the unit. Are the state governments really trying to honour/ help the NoKs or is this a way of finding loop holes in the policies and hiding behind them? Wasn’t Rudyard Kipling right then about the soldiers being slighted? I am reminded here, of a poem about soldiers and politicians. Here is an excerpt of the poem “Just a Common Soldier“, written by Lawrence Vaincourt: “A politician’s stipend and the style in which he lives While the ordinary soldier, who offered up his all, It’s so easy to forget them for it was so long ago, Should you find yourself in danger, with your enemies at hand, He was just a common soldier and his ranks are growing thin, Although the soldiers remain indispensable, politics and the policies of the governments make a mockery of the compensations granted to the families of these bravehearts. The entire nation stands up together for the justice of a reel life hero, who was known for his talent, simplicity and positivity. But what do we as citizens do, when the families of bravehearts suffer in silence? With deep interest we may pursue every conversation, a deceased celebrity had with his family and his love interest. But do we try to find out how a family of a brave heart survives, from the time he is gone and till the time the compensation actually reaches them? Can we only stand with our reel heroes? What about our Real heroes, our men in uniform and their families? Landmark Judgment On Coparcenary Paves Way To Gender Equality:
Our legal system moves slowly but surely. And this was once again proved on Tuesday when the Supreme Court ruled that it did not matter whether the father or the coparcener was alive at the time of passing the inheritance act in 2005. That all daughters would get the inheritance from her father or forefathers as per the Hindu inheritance act 1956 which was amended in 2005 to give equal inheritance rights to the daughter. Though on the face of it this may not look a historical judgment, it would prove to be a milestone on the road to gender equality which has been there in Hindu society. Dr Kislay Panday, advocate Supreme Court of India has welcomed the judgment. “This judgment was called for since its interpretation and execution left many loopholes which could be challenged in the court of law. And this is what was done. Equality of genders is a fundamental principle of any progressive society. The apex court judgment rectifies this flaw and once and for all puts an end to discrimination of sexes while distributing the inheritance. The decision needs to be applauded. I wish it had come earlier!” Dr. KislayPanday of Managium Juris has been pleading for gender neutrality in the law for long. A bench of Justices Arun Mishra, S Abdul Nazeer and M R Shah put an end, ones and for all to the confusion arising from the apex court’s conflicting interpretations of the amended Section 6 of Hindu Succession Act, which came into force from September 9, 2005. The bench said in unequivocal terms that whether the father was alive or not, daughters born before September 9, 2005, could claim equal rights in inheritance. Till the amendment act 2005 was passed Coparcenary property was one which is inherited by a Hindu son from his father, grandfather or great-grandfather. Only a coparcener has the right to demand partition of property. Share in a property increases or decreases by death or birth in a family. The Mitakshara system applicable in various forms to property owned by Hindu families has been the basis of the Hindu Succession Act. Justice Mishra quoted a common saying noted in a 1996 judgment of the SC, to sum up the bench’s view towards daughters, “A son is a son until he gets a wife. A daughter is a daughter throughout her life.” “The reason it annoys many is that they are not comfortable with the idea of women equality. Many laws even after they become operational are often mired in confusion and many times various interpretations are made by the junior courts which nullify the significance of the law. This is what exactly had happened in the case of The Hindu Succession (Amendment) Act, 2005 which gave an inheritance to Indian women (barring Muslim women) and considered them at par with the son. “says, Dr. KislayPanday of Managium Juris the firm that provides pro bono legal aid to women in distress”. The Hindu Succession (Amendment) Act, 2005 gave Hindu women the right to be coparceners or joint legal heirs in the same way a male heir does. “Since the coparcenary is by birth, it is not necessary that the father coparcener should be living as on 9.9.2005,” the court ruling said. It is not always easy to change the mindset and the traditions with a stroke of the pen. Some issues are more emotional and more provocative and thus need to be handled carefully. The Hindu Succession (Amendment) Act, 2005 was not well received in many sections of the society. The hard-line Hindu patriarchal organizations vehemently opposed it on the ground that it would meddle with the traditional Hindu traditions and prove chaotic to the Hindu society. Interestingly, the same group of people would advocate uniform personal law. “Most Hindu hardliners take a very narrow view of women’s rights in property and elsewhere. They quote Manusmriti which says that woman always needs a male guardian, father when child, brother when adolescent, husband when young and son when old. But even Manusmriti is not against women owning the property. It is concerned about the welfare of the women not snatching away her rights.” Says DrKislay. The truth is as traditional Hindu women have always enjoyed property and rights in movable and immovable property albeit her share was less than that of male members. “The ‘Stridhan’ is all about ensuring she owns the property, jewelry, clothes, land, artifacts, cows, etc. which were gifted to her at the time of marriage. And this trend has been there all through history. With the emergence of different schools of Hindu law, the concept of ‘stridhan’ expanded to its literal and legal meaning; granting women more rights to ownership.” says Dr Kislay Panday. Indeed there is always a gap between the social mores and the legal system but like any progressive society, the first change comes through law and then it gradually percolates into the society to become a new reality. In the 21st century when the women are far more aware and empowered the archaic way of life cannot exist and it must conform to the ever-growing gender equality enshrined in our constitution.
